Why your matter ended up at Holland Park

Holland Park is a division of the Brisbane Magistrates Courts District, not a district in its own right. Schedule 1 of the Justices Regulation 2014 (Qld) defines the Holland Park division as the Chandler, Coorparoo, Holland Park, Macgregor and Runcorn electoral wards of the City of Brisbane, together with a carefully described eastern portion of the Moorooka ward.

That produces a catchment across Brisbane's inner and middle south east: charges laid around Holland Park, Coorparoo, Greenslopes, Camp Hill, Carina, Mount Gravatt, Upper Mount Gravatt, Wishart, Mansfield, Sunnybank, Runcorn, Eight Mile Plains and Rochedale ordinarily list here rather than in the city.

A small point on the address. Queensland Courts publishes the courthouse as Holland Park 4121, while the Queensland Government justice of the peace register describes the same building at 8 Marshall Road as Holland Park West. It is one building. Navigate to the street address and do not be thrown if your maps app calls the suburb something slightly different.

The afternoon lists, which catch people out

Most people assume a court date is a morning. At Holland Park several significant lists are not.

• Transport callover, special hardship orders and TORUM applications: 1:30pm. If you are applying for a work licence or a special hardship order here, that is an afternoon listing.
• Civil enforcement hearings: 10:00am.
• Court Link: 11:30am.
• Peace and Good Behaviour complaints: Tuesdays at 2:00pm.

Read the time on your notice, and read the daily law list on the morning. Turning up at 9:00am for a 1:30pm listing wastes your day, and turning up at 1:30pm for a 9:00am listing can produce a warrant.

The Wednesday domestic violence callover

Wednesday at Holland Park is the domestic violence callover, listed at 9:00am. That is the day protection order applications, both police applications and private ones, are brought before the magistrate.

If you are a respondent to an application, the most important thing to understand is that a protection order is a civil order, not a criminal conviction, but breaching one is a criminal offence carrying real penalties including imprisonment. Consenting to an order without admissions is a legitimate and common outcome that is often far better than a contested hearing, and it is not an admission that the allegations are true. Whether it is right for you depends on the conditions sought, on any family law proceedings, and on what a final order will mean for your work, your firearms licence and your contact with your children.

If you are the aggrieved, ask court staff about safe waiting arrangements when you arrive rather than sitting in the public area.

Do not consent to conditions you have not read, and do not agree to an order on the footing that it is "just a piece of paper". It is not.

Getting there

The courthouse is at 8 Marshall Road. TransLink publishes several stops in the immediate area, including a stop on Cannes Street at Marshall Road served by route 113, a stop on Logan Road at Holland Park, and Holland Park West station on the South East Busway, which is served by a large number of routes including the M1 and routes 137, 139, 169, 26, 261, 299 and 555.

Queensland Courts publishes no parking information for this courthouse and neither does Brisbane City Council, so we are not going to state any. It is a suburban arterial location, so allow time and read the signs where you park.

The Thursday close is 4:00pm rather than 4:30pm. If you need the registry counter late in the day, Thursday gives you half an hour less.

What actually happens at a mention

A first mention is short and administrative. The magistrate establishes the charge, whether you have a lawyer, whether you have the police material, and what you propose to do.

You are not required to plead on the first date, and an adjournment to get legal advice is granted routinely. Ask the prosecutor for your QP9 before court, and read it before you decide anything.

The 2026 arrangements note that transferred matters are first transferred to a callover date in Court 2 so a magistrate can be allocated. If your matter has come from another court, expect that step rather than being dealt with immediately.

The duty lawyer at Holland Park

Legal Aid Queensland provides a duty lawyer service at Holland Park for the adult court. The contact published for it is 1300 65 11 88, with the Brisbane crime email bnecrime@legalaid.qld.gov.au.

Legal Aid does not publish set attendance times for the Holland Park duty lawyer, so the practical answer is to arrive when the court opens and ask at the counter straight away.

A duty lawyer can deal with an adjournment, a bail application, a simple plea and a breach. They generally do not take traffic matters, which at this court means the 1:30pm transport and work licence list is not something the service will run for you.
