Samuel Hwang

Samuel Hwang is a partner in the criminal defence team. He has run matters in the Local, District and Supreme Courts of both Queensland and New South Wales, from drink driving through to sexual assault and firearms charges.

Background

Samuel holds an LLB and a Graduate Diploma in Legal Practice.

He practises in criminal defence in two states, which is unusual and useful. Queensland and New South Wales run different codes, different court structures and different sentencing legislation, and a lawyer who has worked in both tends to be less willing to accept that something is simply how it is done.

What he acts in

Samuel has appeared as an advocate in the Local, District and Supreme Courts of New South Wales and the Magistrates, District and Supreme Courts of Queensland. His matters have included:

  • Assault charges.
  • Drug possession and drug supply.
  • Mental health applications.
  • Sexual assault.
  • Larceny and property offences.
  • Drink driving and other traffic charges.
  • Domestic violence matters.
  • Firearm charges.

His working method is to pull a police case apart before deciding anything. Charges get downgraded or withdrawn when the evidence supporting them is tested early, in writing, with the prosecutor, rather than argued about on the steps of a courtroom.
